I applied UK Tier-2 dependent visa for my wife at VFS New Delhi

Along with application, my wife submitted the certificate of maintenance from my sponsor (A rated sponsor) certifying her maintenance in UK. However, the visa was denied on the lack of maintenance evidence.

My wife applied for administrative review and the review was again declined stating that Certificate of Maintenance was not submitted with the original application.

However, the Certificate of Maintenance was present in the documents handed back to my wife after visa rejection which she even showed to person who handed the documents back at VFS office. I see that there is a serious fault in handling documents related to the application.

Hence, I am not sure if it VFS or UKBA who is responsible for the error.

VFS is not replying to the mails and their customer care is worst then hell.

It is an absolute mental harassment effecting both personal and professional life and i am just sending email for last 2 months.

What legal action can be taken against VFS or UKBA as the application was made in India?

Can i reapply and do legal action at same time?

You will not win this fight, it is your word against theirs.

Make a fresh application and give the right documents this time and make sure they fill the VFS checklist in front of you in which they right what documents you have provided (original and copy).
