Unmarried Partner Visa and Intention to Settle

Sorry for the long post but to explain my situation fully...I am a British citizen (by descent - born in Australia to a UK father). My boyfriend is an Aus citizen with no UK ancestry.

We have previously lived in the UK for 18 months until Jan 2008 - my boyfriend on a HSMP visa. We returned to Aus as my father was terminally ill and what was intended to be a short visit has dragged on...In the meantime my boyfriend has been working in Aus effectively on secondment for a company he used to work for, and this secondment runs out in a few months. I have had a few contract jobs here to pay the bills. However we would like to return to the UK to live.

We have lived together for almost 3 years and have plenty of documentation of this, as well as financially I can support him (and me) if we are unable to find work in the UK. I have no family or property in the UK (we were renting a flat before), but have a company there and personal bank accounts still active. I don't own any property in Aus.

My question is - if he applies for the Unmarried Partner visa will our previous stay and departure from the UK have a negative slant on his (and my) "intention to settle" in the UK ?
