unmarried visa for overstayer

am an overstayer in the uk for 5years. in sept 08 me and my partner spoke to a lawyer who adviced us to apply for two applications FLR(m) for unmarried partners and FRL(o) for discrretion leave. Last week i received a phonecall from someone at the home office informing me that i will need to withdraw one application as they will only consider one and that i should withdaro flr(O) as all my documents were with the FLR(M) and she also said that my case worker will contact me to for me to send my new passport to the home office(as i had sent acertified expired passport). i also have a one and a half year old daughter who is british citizen through his dad. does anyone know if this means that they have considered the FLR (m) application or what, please advice as lawyer not helpful.
