Unpaid 76 days outside UK

Post by vik_mad » Thu Apr 21, 2011 4:18 pm

Hello,

Initial HSMP (May-2007) - Extended as TIER 1 (May-2009) - ILR due in May 2012

I will be completing 5 years in May 2012 in the UK however i have on the stretch 76 days stay outside the UK in 2009 back home due to some family emergency. I was not paid for those day as i had to leave my job because of that.

could you please advise if i will still be entitled for ILR in May next year?

Thanks,

As you were on HSMP (and not WP) at that time you should be ok as long as your total absences are not too much (up to 180 is no problem, over 180 needs justification and requires descretion from case worker).
