Unusual Situation

Hi there. I have been following this forum for about 22 months now. Its great. I am not sure if anyone can help me but please feel free to advise.
I am a Doctor in the UK and hold Indian nationality. I applied for HSMP in July 2004 which was eventually approved in December 2004. My FLR(IED) approval came through in January 2005 for 1 year. I then reapplied for an extension and this was approved in November 2005 and so I have current leave to remain till 17/01/2009.
My problems started a month ago. I was appointed to a Specialist Registrar job for 5 years till Feb 2011. With the abolishing of Permit Free training for doctors in training my employing deanery now insists that as I do not have full Leave to cover my employment they should apply for a work permit for me. I DO NOT WANT TO DO THAT as it binds me to one employer.
They say HSMP extensions are not automatic entitlements. I agree as does Home Office. However looking at my case they do not think I shall have a problem.... I have been discussing this with Home Office telephonically for 2 days... they have been very very helpful but cant tell me what to do except that in their opinion too I should not switch... to work permit.
Additionally now extensions are for 4 years on HSMP.... my colleague had it for 4 years... and letter said you may be eligible for ILR at the end of 1+4.
I do not know what to do... one person (in fact more than one) suggested that I apply now for extension citing my problems.... and I may get extension now....
Also what if by the time I apply in Nov 2008 for extension HSMP does not exist... if Tier 1-5 Work Permits come in.... how would I get extension?
Any suggestions?

You may have no choice but to go for the work permit. Neither the deanery nor the home office is likely to budge on this one - many have tried and no-one has succeeded - yet.

And re the work permit binding you to one job - shouldn't you count yourself lucky you have secured a much sought after training number? What is the likelihood of securing another SpR rotation or post with your time limited HSMP - remember this one you got was before the ruling! Surely you realise that whatever job you try to get, you'll run into the same problems?

Hi. I do agree with you at one level that I ought to count myself lucky... at getting the NTN to train. However I am appalled at the way the Home Office have been twisting rules by giving people 4 year extensions. They are doing as they please. I dont plan to let them just 'get away with it'.
Having said that they have been very very supportive on the phone.
Any advice?

dear adi,
i have a same problem,my 3 year hsmp extension is getting expired in jan 2009,i am finshing my gp training this year in july,i contacted them saying that i want tos end my passport now for 1 extra year aupto 2010,but they are saying that i will definetely get 1 year extension,me being a GP,but still i have this uneasy feeling,when i quite a few of my friesndswho are applying for extension now are getting 4 year extesion and guarenteed ILR,i am not sure of what to do about this rather than wait and see.

All I can say is that the lady at the Home Office Leave to Remain team said I could put in an application now for extension from Jan 2009-Jan 2012 now. It may take upto 6 months to get approved...

Hi. Please I still need this situation resolved. I spoke to Home Office today. Seems my original fax from 13 April 06 has been referred to a manager. Will take time but maybe shall get some answers...
