upper tribunal

hi,
my t1 entrepreuner was refused cause home office said they didn't find anything with my application such as bank statement, car, contract etc. just gave me 20 points for english and maintenace. but all has been sent with the application. and it's allbeen listed in the document list in application form. been to first tier court judge was confused about who he is going to believe . he looked at the photocopy and said the contract we sent and doesn;t prove level 4 job.
i found out by phoning court that decision been sent out to my solicitor but he didn't recieved it. sent a fax by requesting to send the deciosion again but they said today its in process, but already been more than a week. they said appeal been dismissed but still don't know reason.
planning to go for upper tribunal but just wondering what the chances are like to get permitted to upper tribunal. solicitor said first tier normally doesn't allow to go for upper tribunal. but we will try in both court.
do you know guys what are the requirements like to go for upper tribunal.
