Urgent advice needed for spouse visa application from outside uk

Post by Parvez2024 » Sun Dec 22, 2024 5:31 pm

Hi,
I need some advice from the senior please. My friend is a British citizen, he is about to apply for his wife's spouse visa from outside UK. All this paperworks are ready to Submit on Monday with a priority service. He earns £33000 and he rented 2 bed house privately.
But the problem is he has been arrested by police last week for suspicious crime. Police had warrent on him and arrested him from home then took him to the custody. They released him with bail condition and without charge because of no enough evidence but pending further investigation . Police didnt took him to the court Police kept his passport and he need to sign in police station every week and he must not travel outside UK.
my concern is in this situation, will this going to effect his wife's application. He ask police but they assure him that there should be any consequences with his wife's application.
Any idea or advice will be highly appreciated.

Kind regard

Police are not experts on immigration matters so would not rely on anything they say in that regard.

That said don't believe there is anything in the caseworkers guidance that covers legal checks on the applicants spouse (your friend).

He should have evidence to cover his job as at now and assume from information you provided his job is not at risk over the next few months when the visa is being processed.

Being arrested is not the same as being convicted and innocent until proven guilty. Nothing may come of this either as not been charged and as you said at this stage not enough evidence.if a complaint was raised then police are duty bound to investigate but still need evidence of a crime to take any further.

Only scenarios I could think of where could be an issue is if he was being investigated for bigamy or marriage for money to support a false visa application which would be relevant to the visa application.

As such at this stage application should be ok.
