Urgent - Can a work permit dependant switch to HSMP Tier I

Urgent - Can a work permit dependant switch to HSMP Tier I

Hi,

I am currently working in UK on my dependant work permit visa & Can I now switch my status onto HSMP Tier I, I have enough points to apply for Tier I.

If the answer is yes, can i apply by staying within UK or do i need to go to home country to switch the visa ?

You can switch to Tier 1 General and you need to go back to you home country and appply from there.below is the policy guidence from UKBA Site.

Switching in to the points-based system
Dependants may not switch into any category of the points-based system in their own right. If your dependants later want to be in the United Kingdom under the points-based system in their own right, they will have to leave the United Kingdom and apply for entry clearance (permission to enter the United Kingdom).
