urgent help please about BC

Hi everyone,
i am married to british citizen i am just woundering can i apply before 3 year of my qualified period because i visited to the UK before many times. can i count those days fo my qualiyfied period.
i have ILR since december 2008 and i am moved here in the uk in october 2008. but i visited before couple of times can i apply bit earlier then october.

Stay in the UK under any "legal" immigration category can be included.

thanks sushdmehta. i need to ask one question. i visited the uk in july 2008 from 21 to 23 so in july 2011 can i apply and which day is count as present in the uk coz i arried in the early morning on 21st and went back at night on 23rd so please clear for me how the ukba count the days

Nazia88, if you do indeed submit the form AN in July 2011, what you need to pay particular attention to is the number of days outside the UK in the previous 3 years.

So you arrived in the UK on a fiancé(e)/spouse visa in October 2008. Since arriving in the UK on that visa, have you had much time outside the UK?

Of course, based upon what you have posted, there is about a 3 month period outside the UK from July 2008 to October 2008. But what other periods outside the UK since October 2008?

thank you john i got spouse visa but soon after passing my KOL test i was granted ILR beause me and my husband were together from last 4 year and we have one son aswel.

after october i only been outside twice and both time for few weeks as i counted it was about 39 days outside to uk all to gether after october 2008.

If you go along to an NCS office of Wednesday 20th July, or if you are intending to post your application, you post it Special Delivery on that day, either way the application should reach UKBA in Liverpool on Thursday 21st July.

The date of of receipt by UKBA marks the end of the 3-year qualifying period. That is, the 3-year period would be from 22.07.08 to 21.07.11.

With you in the UK from 21st to 23rd July 2008, there clearly could be no doubt about an application made as suggested.

Days out of the UK? Clearly not a problem.

one more question as i arrived on 21st of july 2008 and you said i should send my applictaion on 20th with special delivery, would they count my arrival day towards my qualify period ? by they i have proof of my ticket that i arrived in the morning about 9am.
what do you think it would be fine

thank you i understand that and i just red from the UKBA webiste >>>>You must make sure you meet this requirement before you make your application. For example, if we received your application on 25 November 2005, you would have to show that you were in the United Kingdom on 26 November 2002 ok thanks you i will post on 20th so they will recive on 21 july once again thanks for you help i will updates you guyz once its done

i have just noticed and seen my old email and also check my passport i visited to the uk in on 24th june 2008 and i went back on 25th june, dose these days works or not but i think i should stick on july dates please reply when u check this post thnx

Nazia88, do you know, I am not absolutely sure, as regards the actual day of arrival and leaving.

I think it would be far safer to stick with the July date.

i just need to confirm few things if i post my application by lawyer or myself would that be posible to get my passport back for travel purpose after sumbmiting my application.
and 2nd question is wht is the meaning of POST BOX dose homeoffice sign when they recieve any appliction coz i am planning to send my application on special delivery by post thnx

hi guyz i need one quick information plz help me thnx

i supposed to be apply in july but i just found my old ticket. i arrived in the uk on 27th may2008 and i left on 29th may 2008 i also have a proof for this. can i send my application on 26th may 2011 and which will reach at home office on friday 27th may 2011 so by the rule of physical presenst in the uk will be ok coz i was in the uk from 27th to 29th may 2008 and i also fullfilll the others conditions and plz reply me thanks alot

Let's go through this carefully. If the application arrives at UKBA in Liverpool next Friday, 27th May 2011, the 3-year period will be from 28.05.08 to 27.05.11, and were you physically and legally in the UK on 28.05.08? Well yes!

So that looks OK to me, but given that you are now thinking of applying even earlier than previously considered you need to recheck the number of days outside the UK in the period 28.05.08 to 27.05.11, which is bound to be more than the day count you were previously looking at.

Also of course look at the day count out of the UK in the one year to 27.05.11.

Subject to all tests being passed, yes post next Thursday, the 26th, and of course post using Special Delivery .... for two reasons. Firstly that is the only way to guarantee delivery the next day, and secondly it is only Special Delivery envelopes that Royal Mail treat securely, which is important given you will be sending passport and other important documents.

thank you very much for your reply i want to inform you that i have counted those days very carefully and i am not more then 200 days of the uk since then 27may 2008 and plus i also never been out of the uk from the past 12 mounths. but if you want i can scan that sheet and email to you and you can have a look but i think i have counted right days.

plz confirm me one things i didnt count the arriaval days and departure days tas absenet and last thing if i go to france on moday and come back on next day (tuesday) it wib be counted as absent or not thnx

one thing which i realy need to askedyou. from may 2008 to september2008 i wasnt permanent resident of the uk so which address i shoud put on address coz i was just visiting the country but my work and house was in france this is bit confusing me and hope you or some other member will reply to me thnx.
