thanks sushdmehta. i need to ask one question. i visited the uk in july 2008 from 21 to 23 so in july 2011 can i apply and which day is count as present in the uk coz i arried in the early morning on 21st and went back at night on 23rd so please clear for me how the ukba count the dayssushdmehta wrote:Stay in the UK under any "legal" immigration category can be included.

So you arrived in the UK on a fiancé(e)/spouse visa in October 2008. Since arriving in the UK on that visa, have you had much time outside the UK?
Of course, based upon what you have posted, there is about a 3 month period outside the UK from July 2008 to October 2008. But what other periods outside the UK since October 2008?

So that looks OK to me, but given that you are now thinking of applying even earlier than previously considered you need to recheck the number of days outside the UK in the period 28.05.08 to 27.05.11, which is bound to be more than the day count you were previously looking at.
Also of course look at the day count out of the UK in the one year to 27.05.11.
Subject to all tests being passed, yes post next Thursday, the 26th, and of course post using Special Delivery .... for two reasons. Firstly that is the only way to guarantee delivery the next day, and secondly it is only Special Delivery envelopes that Royal Mail treat securely, which is important given you will be sending passport and other important documents.
