Urgent help reg. Prev earnings..

Post by hsmpseek » Mon Dec 03, 2007 9:42 pm

Hi,

I have some concerns about previous earnings.

I wish to claim 45 points for salary earned in India during the period of Oct-2006 to Sep-2007 considering country code D and band as 7500+.

During this period I was transferred to same company's UK branch for 1 month and 25 days on work permit and during this period salary was paid in UK bank account. Can I instruct Home Office HSMP to not to calculate my salary on pro-rata basis since I am able to match the specified band by considering salary earned in India and ignoring the one earned in UK?

Because collecting UK salary evidence is difficult for me now.. Or is it essential to furnish salary details for each month falling in 12 months?

PLEASE guide me on this. It will be a grreat help!!!!

Thanks in advance..

Hi,

Since you worked longer in India than in the UK, even it comes to prorating earnings, HO will prorate your India pay and not your UK pay.

While it is perfectly okay to ask HO to consider only 11 months payslips, you still have to submit payslips for the whole 12 months.

If you have 12 months' payslips, with one month displaying salary paid in the UK, it makes your case foolproof and you can then request the HO to prorate the 11 months' pay to 12 months. The evidence you produce must ofcourse be consistent with each other.

You can read more about how the HO considers previous earnings in the caseworker guidelines:

All the best.

Excluding UK salary from calculation

Post by hsmpseek » Tue Dec 04, 2007 10:25 pm

Hi Gorajim,

Thanks a lot for your response.

But I do not wish to calculate my salary on pro-rata basis and also I do not want to consider my UK salary in calculation. Do I still need to submit UK salary slip and bank statement. I hope NO. :-|
