Urgent-ILR application eligibility

Post by Bristol2011 » Sun Jun 12, 2011 9:07 am

I have an unusal situation.
I have started to work under the work permit ( currently refer to Tie2) visa from July 2007. My visa is going to expire in July, this year.
I am married to a British citizen and we will be married for two years by July this year too.
My questions are:
1. Am I eligible to apply for ILR as a partener to a British citizen in July because I would have been married for two years?

2. Or do I apply for a Tie2 work permit in July this year? So I will be eligible to apply for ILR next July?

Many thanks.

You are a Tier 2 migrant so you cannot apply for settlement as a partner of a British citizen.

If you wish to take the family route to settlement then you must first switch from Tier 2 to partner of British citizen and then (under current rules) apply for settlement after living in the UK for at least 2 years as partner of British citizen.
Life isn't fair, but you can be!
