Urgent- Overstay and appllied for Tier 2 FLR

Dear Sir,

My current status is workpermit holder as dentist with 5 years visa up to March 2013 issued on March 2008.

I currently applied for Tier 2 FLR as dentist with sponser certificate of 3 years by another employer. It was window service- in person by my immigration solicitor.
They told that they cant decide application on same day but will decide in 6 weeks as there is adverse immigration history.

I came in this country on spouse visa. at the end of 2 years probationary period wife was not with me but there were chances that we might join again. I overstayed for 4 months in 2007 from Feb to June. In the mean time i got workpermit as dental practice manager for 5 years and went to india for entry clearance where i got 5 years visa Up to 2012.

I passed my dental exam and became dentist.In 2008 July got workpermit as dentist and got visa for 5 years up to 2014.This was in country FLR

My worry is that - will that overstay will affect my tier 2 visa application even though I have been granted 5 years visa 2 times after this overstay.

I would be grateful for your views and any advice.

Immidiately after overstay when i went to india my first workpermit visa was issued in Aug 2007 as dental practice manager.
So I already passed 2 years and 3 months on workpermit thought initially as manager and then dentist. I need another 2 years 7 months for ILR.

New employer has issued me 3 years sponser certificate. so this will lead to ILR if i am granted visa.

Will my visa refused for Tier 2?
If refused will it affect my current visa as workpermit holder which is up to 2013 as i can still continue to work with current employer ?

Please give me some advise.

I have been on a 5 year work permit and I recently moved to Tier 2 as I got a new job.

Your Tier 2 application outcome has no affect on your current work permit. If the Tier2 is refused (which happened to me first time when we applied), you will still be able to live and work until the leave previosuly granted to you.

If your Tier 2 is sucessful (which happened to me during my second application) then it will override your work permit from the start date mentioned on the certificate of sponsorship, and you can then start your new job.

With regards to the visa outcome because of your overstay, I am unable to answer that. You might need expert advise.

I am concerned about overstay. is there anyone who can put a light on this area ? I would be grateful.
Another thing i forgot to mention my speeding pentaly £ 60 and 3 points on my licence. I sent a seperate letter to home office saying that i missed that sentence while filling the application. They specifically say about this in the application in brackate like (including driving offences)

Let's see what happens.
