Urgent ROR or Unmarried partner visa help!!!

Post by Ola8 » Sun Feb 09, 2014 9:29 pm

Hi all,

I obtained a resident permit after marrying my EEA national in 2011. However we separated in 2012 and I have been in a relationship with another EEA national since then. Me and my ex wife are starting proceedings for divorce in the next days(legally married for 3 years), and she lives and works in the UK but we meet but are not on speaking terms. I am currently working and exercising treaty like and EEA national. My questions are, 1. In order to claim a ROR, would I need to prove that we lived together or that we have been economically active for 1 year? 2. Would the 2 years of living together with my current partner count towards an unmarried partner visa? I know that this must be applied for after my divorce, but would I have to start counting the 2 years after the divorce? Many thanks.

Depending on the circumstances, you may be able to retain right of residence.

You cannot qualify as a durable partner if you are still married to an EEA national.

You will need to establish that she was a qualified person on termination of your marriage.
