hi,

Today I have received a refusal letter for my tier1 psw visa application.
I also received a right to appeal however the letter states that option to make new application is as under:

If you are not entitled to a statuatory right of appeal you may wish to submit a fresh application with additional info with all supporting documents and fees. Alternatively if you wish to apply for leave to remain in another capacity you must do so on the appropriate application form with appropriate fee.

Does this mean that cause if I do have a right of appeal I cannot make a fresh application in another capacity?

Please help urgently.
Can also please pass on the immigration solicitor details who works on saturday and can help me in my case.

You have a right of appeal but you also have the option to submit a fresh application within 28 days after refusal either in the same category or under any other visa category that you meet the requirement.

But mind you, you wont get any appeal right if subsequent application get refused.

Can you state your refusal reason/s and that will determine if your appeal have a better chance or not.

The reasons of refusal are as below:

1.funds 50 K though available in llyods bank personal account an updated bank letter was submited confirming the recent balance which was transfered from India by my uncle and other relatives. HO thinks that just acces to these funds does not mean it is available for my business and in an interview I had informed HO that these are my own funds.

2. Business plan is a copy and paste from bplan sample.. which was made by my stupid consultant.

3. I have MBA certificate and work exp in different councils hence no exp as a business consultant which would not make me a genuine business person.

I am thinking of switching into tier 4 category by booking an urgent personal appointment, but not sure which uni/institute will issue me a CAS..

Hi sorry to hear that, I think as far as your statement and experience is concerned you've good chance to win through a good solicitor but only thing which is not in your favour is business plan....any way don't worry be patient may Allah help you through this hard time!
one question plz where was your interview,when and how long did it take ?
