Valid passport : required ?

Hi everyone,

I'm a EEA and my non-EEA wife applied for a Resident Card. The application was unsuccessful and we plan to make appeal, but her Passport is not valid any more.

Our advisor told us it doesn't matter, but a friend of mine said that without it our appeal or any fresh application cannot succeed.

Could someone tell me who's right ?

People have been refused because of an invalid passport! Best she apply for a new passport from her embassy asap!

Technically it would be ok.If you got visa you can stamped it on new passport easily.For appeal I am sure you have no problem with old passport.

Regardless of legality, I would stronly recommend that your wife obtains a new passport asap from her embassy and the Resident Card is put in that.

If the Resident Card is placed in the old passport, it means having to carry the old and the new passports every time she travels (or paying £165 for a Transfer of Conditions).

Is there a way to renew a passport remotely without having to move to the embassy at London ? (no embassy of her country where we live)

What country are we talking about? Check (google :idea:) the concerned country website on what it says about renewing passports for their citizens! :roll:
