Validity of divorce in India and EEA-Retained Rights

Post by sheikhazad » Tue Jun 24, 2014 12:33 am

Hello,

I am non-EEA national married to EEA national. We are going to divorce. We are both in UK. We are in process of getting divorce from India just like we did our marriage in India on religious basis. We will sign our divorce documents here and send to India. Kindly note that religious divorce/marriage is accepted by Indian govt.

Will such divorce done outside UK acceptable to apply for EEA Retained rights of residence? Is there any condition that divorce should be done in UK court only? Kindly let me know. After this she will not give any employment proof.

Can I apply EEA Retained Right of residence with this divorce from India?

Thanks a lot.
