Variation of student extension application to PSW

Post by saeedusman » Fri Jul 16, 2010 5:18 pm

Hi Everybody,

I am very thankful to all the support from this forum which I got recently and send a valid student extension application.

If someone want to have a look on my previous post, please follow the link (However I will put all the main points here in new post as well)

http://www.immigrationboards.com/viewtopic.php?t=55285

I have valid student extension application with the home office and waiting for the decision.

Actually I got referred in my project and needed to submit that again. The next due date was after the expiry of my visa.

At first I got 18 months visa when I came in UK. I was supposed to finish in January 2010 but got referred and needed to submit again on 2nd June 2010. My visa was going to expire on 31st May 2010.

At first, the university was not giving me CAS letter, but I discussed here in previous post and somehow managed to get CAS letter till 3rd June 2010.

I applied on 29th May 2010 and fulfilled all the requirements like funding and CAS letter hence full 40 marks for valid application. I have also given biometrics on this 6th July and has not got any decision yet.

I am worry that I already had 18 months visa and by the time homeoffice decide my application, the date on CAS letter (3rd June) has also passed and now they clearly know that till this time I have finished my course.

So is there any chance that on this basis they can reject/refuse my application for further extension?

What I am thinking to switch that existing application to PSW because I have attended my ceremony on 13th July and today got the PSW letter from university as well which states that I have achieved my Masters degree on 9th July 2010 and my course started on 6th October 2008 and ended on 9th July 2010.

I have seen one documents Section 5C article 3c & 3d. It clearly tells that we can vary the application under 3c. But today I had talk with my advisor at university who deals with PSW and she said that it is very complicated and I need to see some immigration solicitor.

Personally I wish to wait for decision first and then once I got some extension visa (even 2-3 months or more or less) and then put new PSW application. This will give me enough time to arrange finances for the new PSW fee and will be more convenient.

But some of my friends told me that I might get refusal because I have already availed 18 months visa and home office can object this point. Or other thing the home office can object and make the grounds of refusal that my course is finished now and now I should leave the country within 28 days or something like this.

I am totally confused. Even if I get one week visa, It will be OK for me and in that time I will put PSW application.

But in case they refuse my application, then it will end my legal stay and then at that time I will not be even able to make PSW application.

You can clearly see the DUAL policy of university, on the CAS letter they wrote end date as 3rd June 2010 but the letter I got today for PSW show that my course ended on 9th July 2010.

I have tried to explain everything but if someone want some further information, please tell me.

What will be the best thing to do? There is also chance that If I send new application some day on next week and might get my decision on the first one next day.

Do you all recommend me to wait and should I be hopeful that I will get some extension?

The time frame for my extension application is given below and now a days, some of my friends have got their decision after 10-14 days after the biometrics.

Application sent: 29th May 2010
Acknowledgement received: 3rd June
Biometrics letter: 7th June
Biometrics booked: 9th June (and got date as 6th July which was the first available date in Glasgow at that time)
Biometrics given: 6th July

And now waiting for the decision.

Now I have attended my graduation ceremony as well and has got the PSW letter from university with which I can apply for PSW. I will get my degree on 21st July.

I will greatly appreciate your guideline and reply.

According your experience and knowledge, do you think that homeoffice can refuse that it is just 3 days extension or I have completed my course till now or I have already availed 18 months visa.

If it is the rule that course duration plus 4 months, then I should get some extension. Is not it like this?

What can be the point homeoffice might refuse/reject extension?
