VERY messy situation re In Laws - any advice welcome

Post by confused&concerned » Mon Jan 17, 2011 11:40 am

I married a Brazilian 3 years ago whose immediate family was already over here, he is completely legal (he's now got ILR) and I believed his siblings were (at least until recently) but his parents, unbeknown to me, have been illegally here for many years (10 to be precise). When I say unbeknown to me I mean that I have asked the question on numerous occasions and have been misled.

One of his siblings has just been removed back to Brazil and the parents were given the 2 forms to state that firstly the decision to remove them was being considered and secondly that the decision has been taken to remove them and to report to the home office on X date.

There WERE going to appeal the decision based on the fathers health (in the past 10 years he has had a heart attack and a pacemaker fitted, a stroke and now has suspected prostate cancer (all treated by the NHS) - not that I was convinced that this would be successful after reading some case notes on similar situations, but the father is now saying he wants to go back to Brazil and will tell the home office this and make arrangements to go, so that route of appeal would no longer be an option to the mother anyway, who desperately wants to stay in the UK.

The solicitor has managed to get an extension of a few days and they're now to report this week ....except that I was told that she (the mother) has now said that she is not going to turn up to the immigration meeting!!!

Now from what I can gather (not that there's much information out there about this kind of situation) if she does that they will just come and find her and as opposed to letting her stay at home until her removal, she'll be detained in an immigration removal centre (just as his brother was recently) and then removed. Not at all nice, especially as she doesn't speak a word of English (even after 10 years) so will have great difficulty communicating with anyone in there. Does anyone know any more regarding what may happen to her if she simply doesn't turn up, or if indeed she would have any other possible grounds for appeal?
