UK Spouse Visa - sponsor returning to UK - financial requirement

Post by pebb1ee » Mon Mar 11, 2024 7:00 am

Hi,

I am a British Citizen, living in Middleeast. I am applying for UK Spouse visa for my partner (overseas sponsor returning to the UK) using
Category A (With current employer for 6 months or more
and
Category C (property rental income)
with a job offer in the UK.

My foreign employment pay is below the financial requirement (around 3000£ a year and I have been working for more than 2 years)
Adding the property rental income, we meet the £18,600 benchmark.
When filling up the application form online, in the employment section, it asks to select one of the following:

1) The same amount continuously, above the financial requirement amount
2) The same amount continuously, below the financial requirement amount
3) Not the same amount continuously, above the financial requirement amount
4) Not the same amount continuously, below the financial requirement amount

When i have selected 2 (as my salaried income is less than 18.6k), it asks me for 12 months payslips. According to Appendix FM Section 1.7, it states that if you are working with an employer for more than 6 months, than you have to provide 6 months payslips.
I am very confused at the moment. Did I make the wrong selection? Should I be selecting 1, instead of 2?
Please advice, thanks

Re: UK Spouse Visa - sponsor returning to UK - financial requirement

The information which I have provided on the application form such as the salaried employment income is below the threshold 18.6k, which is why they are asking for 12 months payslips (which includes present/previous employers. This means they are already assessing my application using Category B and not Category A.

Under Category B, our assessment of the financial requirement will be based on:

1) The applicant’s partner must have a confirmed offer of salaried or non-salaried
employment to return to in the UK (starting within 3 months of their return) with
2) The gross amount of salaried overseas employment income in the 12 months prior to the
date of application
3) The gross amount of any specified non-employment income received by the
applicant’s partner, the applicant or both jointly, provided they continue to own
the relevant asset (for example, property rental income) at the date of
application

Please advice if i should use Category B and mention using this category within the cover letter, thanks

vfs global pakistan - no option to upload documents

Post by pebb1ee » Tue Mar 12, 2024 7:44 pm

I have paid the IHS and the UK Visa fees for UK Spouse application (overseas sponsor returning to the UK)
for my wife. When it takes me to the VFS global website (pakistan version), it is asking me to book the biometrics appointment but does not give me any option to upload documents. Someone who has used vfs global within Pakistan can confirm if they have faced the same issue?
I am worried if i go to the biometrics appointment and the documents are not uploaded than the application will get refused.
