Indian Passport holder with Portuguese birth registration

Hi ,
I have recently registered my birth in Portugal, My Indian passport was issued for 20 years.
Now there is a circular that passports issued for more than 5 years will not be valid.
If I want to change the passport will there be a fine for me? as I don't have a option . I want to hand over my Indian passport and take a surrender certificate till then I have to use the Indian passport. How much fine will I have to pay since I will have to get a New passport because my old passport will not be valid.
Also I read that if you do not surrender you Indian Passport there is imprisonment for 5 years? Or is it just the fine we have to pay.
