UK Citizen moving to Netherlands for study, Indian spouse

Post by FatboyJaxx » Sat Mar 07, 2015 3:55 pm

Hi,

I am currently in the UK with my Indian wife however we are returning to India together on the 11th March. She is here on a family visitor visa which expires in July this year. I am starting a bachelors degree in the Netherlands in September.

When I move to the Netherlands I would like to have my wife join me.

Is there a way we could return to the UK before her visa expires and travel to the Netherlands then apply for a residence permit for her to remain with me in the Netherlands under EU law?

If this is not possible then would we be able to return to the UK until the end of her family visitor visa and then have her return to India until I start my course when I can apply for her to come and join me, again under EU law as I will not have an income being a student there?

For either of these routes, which laws must we apply for the residence permit under and which forms are required?

I have been reading a lot about the immigration laws in the EU and it is all pretty confusing as the individual countries have their own laws which are then trumped by EU law in some cases which means there is a lot of conflicting information. Can anyone please help?
