Hello,

I wonder if somebody has some insights into this...
I am a non-eu citizen , working in UK on tier 2. I am going to apply for the German Residence permit via the family reunion route. I have question... I have question if I can still work in UK and also, have my german residence permit. The reason being I am some 8 months away from ILR..Also, I'd prefer to continue here in UK as the pound stirling is better than Euro and the language is not a major hinder for me in moving up the corporate ladder...The German residence permit is because the partner is in germany and I would have a address in germany as well to where I can travel as I want, while I will continue working in UK as I Am doing currently..I know this is kind of..Have your cake and eat it too moment.. but if there is a possibility...

I see several problems with this.

You will receive a 90 day visa to travel to Germany and to apply for a spouse residence permit valid for one year.

In order to apply for the permit, you need to register your address in Germany and show health insurance.

Now, if you are not working, you can be insured under your spouse but since you have income from your job in the UK, this would be committing fraud.

You will also probably be asked to attend a mandatory integration course of 660 lessons (German language and culture) - when will you do that?

Also, once registered you'd be tax resident in Germany and if you don't declare your UK income, you are committing tax fraud. (Nevermind that being registered at an address where you are not resident is also an offence...)

If you stay outside Germany for more than six months, your residence permit will become invalid automatically. As there are entry and exit checks in Germany and in Schengen, this is likely to be looked at.

A residence permit is meant for somebody to reside in Germany, not to facilitate travel. I think what you are planning is very risky.

I think you'd better apply for a multiple entry long term Schengen visa to go see your spouse. If you are close to getting ILR you are also close to being able to apply for British citizenship. Just stick it out until then.
