Help_IND decission_Becoming a dutch citizen

Help please,

I am Nigerian living with my partner. I came to the Netherlands in May 2004. I started studying at Fontys Hogescholen in September of the same year. In parallel to my studies, i was also doing the inburgering program parallel to my electrical/electrical Engineering course. In 2005, i finished and passed inburgering exams,was invited to the gemeete Eindhoven where i was given my inburgering certificaat in a very big ceremony. During the ceremony, the city hall official during her speech, the official told us that they are proud of us,moreover, that they are very looking very forward to welcoming us in 2 years a dutch citizens.

The 7th of June 2007 was my due day to apply for a Dutch passport. On the 11th of June 2007, i found the time to go to the city hall to apply for a dutch passport, i was asked to bring some documents,including my inburgering certificaat and ROC result showing that i have finished the inburgering exam. I did give all the required documents and i was asked to pay the fee and i did.

On the 13th of Nov 2004, i came back from school and saw a letter from IND in our post bus. I was very happy that IND have approved my Dutch citizenship. To my greatest surprise, it was a letter from IND asking me that i have to do Maatschapplijke Orientatie over again because on ROC result and certificaat it was written that i have finished the inburgering exam with NT2 level and Maatschapplijke Orientatie =Voldoende. They said that i have two weeks to get back to them or my application will be canceled. They also said in the letter that the law has been changed from 1 april 2007,for that reason that i need to have 80% in Maatschapplijke Orientatie to be qualified for dutch passport. I cant find any justification for me to do an exam which i have done in 2005,received a certificate showing that i have finished the program in 2005 successfully again. IF the law is changed in 2007, how can this law affect people like me who have done and finished with the exam in 2005? The same law states that i have to do my inburgering program immediately when i came to The Netherlands, same law states that i have to wait for three years before i can apply for a dutch passport cos i am living with a Netherlands's partner.They know that i can only use my inburgering certificate when i am due to apply for a dutch passport and that that will take some years. Now, they are trying to punish me for obeying their laws? or is this just a trick or a mistake? i am very confused, but have to stay strong because i am in the final year of my studies and need rest of mind to be able to finish my school successfully.

To make my case worst, i have a contract with Philips for my graduation internship,which i will be going outside if the Netherlands for 6 months to do. One of the reasons why i was given the assignment was because i am expecting to get my Dutch passport soon. Now, i am at the point of loosing my graduation assignment for what i have done and have a prove that i have done it. Why did i recieve the inburgering certificate if i cant use it to get my right? Why did i waste all the time going for inburgering program if it will not be respected?why did the gemeente accept my application and money without telling me that the law is changed?why did my application stay 5 months by the IND before they know that they will tell me that a law that is changed in 1 April 2007 is affecting an exam i did in 2005? If this exam is not recognized, how am i sure that when i do the new exam, that it will count, because i am afraid that i will still be told that another law have changed along the line. This is really disturbing me especially,since it is affecting my school and my graduation. Please, what can i do as i have just some few days to get back to IND. I really need your help and advice. I am a student and do not have the money to start a legal case with IND. In three years and few month i have been here in Holland, i have completed my inburgering program,about to complete my bachelor program in Engineering. I have shown that i am a serious person and deserves some compliment, rather, i am getting this type of letter from IND.

There is a change to the required score mark to 80 %.If your ROC result shows you have got such a mark,get a letter from the school and send to the IND.Otherwise,a retake will be the best option.

I have a certificaat shwoing that i have completed the inburgering program. So, if i have not completed the inburgering program sucessfully, why did the gemeente give me the inburgering certificate? the reason IND is giving me is that there is a change in law from 1 april 2007 that i need to have 80%,but why should i be punished for a law that changed in 2007 when i did and pass the exam in 2005? I have gone to ROC,gemeente and the bureau inburgering, they told me that they have not seen this situation before because i have a physical evidence(my inburgering certificate) showing that i have sucessfully completed the program in 2005. On IND website, it is stated there that the inburgering certificate is the prove to show that one has completed the inburgering program. Since the ROC,gemeente and bureau inburgering has refused to give me any letter to send to IND what can i do? in the letter IND sent to me, they also said that i can get a letter from the gemeente to show that i have completed the program.What prove do i need more when i have my inburgering certificate? I am really confused and dont get all this. I dont know what they really want from me. Or are they playing games with me or is this just a mistake from IND?

The best thing for you to do is phone the IND yourself and explain your situation to them. Tell them that you did your inburgerin examen before the new law came in and therefore should be allowed to apply for your citizenship. See what they say.... Your best option would be to act quickly as you only have two weeks left..


I think they are being unfair to you....
