same sex de facto in the netherlands and spain?

Post by missrae » Thu Jan 24, 2008 3:27 am

My girlfriend is Hungarian & im an Australian citizen, we are both wanting to move to a new city & were thinking about Amsterdam or Barcelona. Do those cities recognise same sex de facto visas? How realistic would it be for me to apply for such a visa in either city considering we both don't speak Dutch nor Spanish, however we would be keen to learn.

What do you mean by a "same gender de facto visa"?

How long have you lived together and do you have an extensive documentaton trail which highlight's your relationship together?

We have been together for over a year and have been living together for a year. Yes we have some documentation such as joint accounts, our lease is on both names, pictures, visits to her hometown in Hungary etc.
We just want to live somewhere in the EU, Amsterdam or Spain would be ideal, however London is an option if language is going to be a barrier.

You would be applying as the partner of an EU citizen under Directive 2004/38/EC.

Language is never an issue under the directive.

The main issues would be (1) transitionary restrictions, if any, for Hungary (though I think those are no longer in place in Netherlands). Check details from each country you are interested in.

Other issue is probably having some hassle and having to push to have your relationship accepted as real and substantial after only 1 year. You may have to push for a bit to make this happen.
