Non EU-citizen trying to marry UK citizen living in France

Post by Dudrik » Fri Feb 22, 2008 9:51 am

Hello there!
I would like to make clear my situation.
My boyfrend and I decided to marry. He is a UK citizen permanently living and working in France, I'm Russian and living in my domestic country.
During my visits to France we applied for marriage in local Town Hall and even got the Marriage Certificate and 'Certificate de non-opposition'. But when I applied to French Embassy in Moscow for visa 'Long sejour' to get married they refused me, because he is not a French citizen. At the moment, the days limit according to my Shengen visa is over and I have to wait three months period for the new one. But I'm not sure that it will be right to get visitor visa to marry in France and then apply there for 'carte de sejour'. Could anybody give a piece of advise? Thank you in advance.

You got a marriage certificate? You are married already then?

If not, I suggest:

Apply for a UK marriage visit visa (a visit visa, NOT a settlement visa).

Get married in the UK.

Apply to french embassy in London for family permit to enter France and live with him.

Privetik Dudrik..

Why not apply under EEA rules? Usually much easier and free!

I don't know anything about how the French implement the EEA rules you or ur husband will need to research it...

Thank you for such a prompt reply!
No, we did not married yet.
We have considered this variant, but the problem is that
1. this variant need at least 7 clear days of stay in UK
2. we afraid that the athouryties may consider this mariage as a marriage of convenience

I've got it.
But these rules applies only for family members, which I'm going to be. I'm not a subject for application of these rules.

Well, you need to get married somewhere. Does not really matter where.

What sort of visa can you get for France in order to marry there?

I'm afraid that if I'll marry ourside the France they could say that it was 'mariage blanche'. The least of all would I want face with abolished mariage.
On the other hand, three months waiting period is undesirable. And even I would wait these three months and get a Visitor Visa (Type C), I'm not sure that I will be able to marry with this kind of visa.

Can you not get married in Russia? I know ZAGS need 32 days residency but and bottle of Scotch and a doctors note gets by that.

I see, you know very well Russian athorities :D
The problem is that my fiance has now a business visa to Russia for one year. And the Russian migration rules restrict to get married with this tipe of visa. I have to send a special invitation (usually takes 1 month), they Russian embassy will annulate the business visa (wich is not acceptable) and issue a guest visa, and only after that we could submit our application. So, it's easier for me to wait almost the same time, get the short stay visa to France (where everything is already ready) and get married there. :D

Several of my friends married their Russian fiancees in Czech Rep - easy to get visa and no residency or so it seems...

We've submitted all the nessasary papers in France and I have a certificate that in 2 months there will be our marriage. The problem is that I can not enter the France at this very day - I've spent all my limit of days of stay in Schengen. And I'm looking for another variants to enter France earlier (if there are any), then in three months, which I have to wait till my old visa expires.
