Job Contract

Hello Friends,

I am 27 year old non EU national currently residing in Belgium. Recently i had signed a job contract with a company based in Luxembourg. The company had applied for my work permit to the Luxembourg Work Permit Authorities. But due to some problems i have to return to my country. So i would like to cancel my job contract and request the company to withdraw my work permit request. I have not yet started to work with the company, just signed the contract and have applied for my work permit. Can anyone help me how to go for cancellation of contract ? Are there any legal issues involved for me ?Thanks for your comments and guidelines.

Just write to the Personnel department of the company telling them of your problem, and inform them that you will not be taking up their job offer. They will handle the rest

Yes, just let the company know, by writing to the contact that you have there, or if more than one contact, by writing to the human resources/personnel contact and perhaps copying the other one in.

I don't know anything about Luxembourg law, but although it might be that they could in theory take legal action against you, it would be absolutely extraordinary — and unheard of — if they did. And after all, what would be the benefit for them in doing that? Unless you were being employed at a very high level indeed (and even then probably), none at all. These things happen and companies accept them. They could also, I suppose, mumble about recruitment costs and so on, but in reality they won't: again, companies accept that they have to bear these sorts of costs sometimes.

If you want, you could note in your letter that you would still be interested in working for them at a future time, if that is so — it might lead to nothing at all, but it can't hurt.

I hope everything turns out all right at home in India.

Do you guys think the company has to give any reasons to the work permit authorities while withdrawing our work permit request?
