Post by ricky » Fri May 16, 2008 7:33 pm

i am a non EU , with an immigration history (overtayer in uk)
i will be leaving uk in next few days , planning to get married with my fiance in my country
we decided not bother waste time and money with the british embassy in my country , but try a new life in an other eu country (sweden may be )
my future wife will move there get a job then send for me
our worry is the following:
will my IS 151, and my immigration history (overstying) affect my EEA family permit
i am planning to be truthful and include my immigration history?
do you think guys they will refuse my application ???and tele me you were overstayer in ENgland not alowed here

on what grounds an EEA application is refused nomally?

Ricky, the following link will be a good point to start and read up concerning Sweden. Click on EU and then EU/EEA citizens in the left hand side column and read that bit to familiarise yourself with your wife's rights as an EU citizen and then click on Residence card , which will apply to you.

Since you will be the spouse of an EU national and if moving to Sweden you and your wife will be making use of European law and i doubt very much that your overstay in the UK, will have any effect on your application for residency in Sweden as a spouse of an EU national. You will have to apply for a schengen visa for Sweden in your home country, and then proceed to Sweden where you'll follow the procedure laid out in the section Residence card on the link following.

Hope that helps
