Australian overstayed in Schengen area.

Post by ghotipele » Sun Feb 01, 2009 8:37 pm

I have a question on behalf my friend currently exploring Europe.

Situation:
She's an Australian citizen, entered Schengen area via the Netherlands in August 2008 with initial idea to travel 3 months visa-free as allowed.
However, she's been within Schengen ever since (France for the last few months) and is planning to take a flight back from Amsterdam in July 2009 only.

Question:
What implications / problems she can expect with Dutch immigration authorities?
Is there any difference - leaving now or in July since 'crime' is already done)?
Is there any way to 'fix' this? (too late for visa I reckon'... any loophole?)

Will appreciate any assistance on this one.

Cheers.

She is like every other person that overstays a visa - even though she is non - visa required!! She is an overstayer....more than likely they will input her data into the SIS system....so in future should she want to travel to Europe she will find it extremely difficult to enter due to her past overstays....Don't see her having trouble getting out.....but as for July is it not better to leave asap!!! Why wait until July??? She is just making a bad situation worse!

Is there any reason why she is only planning to leave in July? Is she working or studying without authorisation?

Neither. She just found some guy in France and fall for him. That is also the reason she told me she would better stay in Europe with him as long as she can (before open date ticket expires). Not much to add, to be honest.

Thanks for advise anyway.
