Travel to non uk eu countries with non-eu spouse

Post by waitinggame52 » Thu Nov 04, 2010 1:20 pm

Hi,

Hope someone can give some useful info.

I am a British Citizen by birth.
My wife is a Russian Citizen with 2 years ltr in the uk on basis of spouse.

Say we go to holiday to france, belgium and germany for a week, I have two questions:

1) I've read elsewhere that she needs a schengen visa in her passport - if so whats the longest multiple entry schengen visa we can get and how much does it cost ?

2) My understanding of EU treaty rights is that i can in fact take her to ANY eu country that is not the UK for as long as i like, we can set up home and work there if we like, with no permits or visa's at all. I would be an EU citizen exercising treaty rights outside the UK. That being the case surely all we need is our passports and marriage certificate, and would be exempt from her having to hold a schengen visa ?

Thanks in advance for any replies.

1) It should not cost anything for you but the question regarding length or even of multiple entry cannot be answered. Depends on many factors like the country you are applying to, past travel history, your negotiation skills, etc.

2) You would still formally need an entry visa (Schengen visa obviously if it is a Schengen country). You may be required to register your presence and you activity in the host member state if you plan to stay there for longer.
