Married to EU National, Rights in other EU countries

Post by scootermclean » Wed Jan 19, 2011 4:35 pm

Hello,
I am an American planning to get married in March/April to a Portuguese citizen in Portugal. My question is after we are legally married and I have obtained my Portuguese residency, if my wife gets a job offer in another EU country (Germany, France, Austria, etc etc etc) What are my rights in other EU countries?
Do I have the right to freely reside? Do I have the right to work (without applying for a work visa, etc)?

Thank you

You will have work and residence rights provided the EEA national is exercising treaty rights in that member state, see Directive 2004/38/EC (and the national implementations). Note, that you will have to reside together in the same member state otherwise you will need a residence permit in your own right.
