Can my mum (non eu) go Poland w/o visa wif her husband(eu) ?

Post by summerbreeze » Tue Oct 09, 2012 6:38 pm

I have a church wedding and second wedding party in end of october in Poland (Im turkish and my wife is polish) and of course I want my mother (turkish and non eu citizen) and my step father (english and eu citizen) to visit us for this beautiful day.

My mum has been living in England with her husband for almost 4 years and She has a residence card.

My question is simple, Can they enter to Poland together without visa?

thank you

UK Residence Card of a Family Member of an EEA National.
Your mom has not got a "Residence Card". She has ILR. So technically they can require her to have a visa.

But it should be issued easily.

She should always keep in mind MRAX. See http://eumovement.wordpress.com/2010/08 ... to-travel/ She could, worst case with her marriage certificate and her husband, take the ferry / train to france and from there go to Poland

ILR does not count as a residence card as per directive.

Your mum can travel without valid residence card though, as long as her husband travels with her, and it´s all described here:

(scroll down to "EEA family member without Residence Card (Part 2)")
