Dep visa query

Post by jayparmar » Mon Mar 10, 2014 4:28 pm

Hi All,

I have to apply for my second tier 1 extension as my visa is expiring on Oct 2014. I need to apply for the tier 1 visa as I am 1 month sort of my 5 year eligible period for ILR. My question is, my wife's visa is also expiring on Oct 2014. so Once I apply for her visa with my second tier 1 ext. , I suppose we both will get 2 years visa, but I will again apply for ILR in a month time, so do i need to apply for my wife's visa again?

Thanks in advance

If you wife was given a dependant visa according to the rules in place before Jul'12 and has stayed with you for over two years she can then apply for ILR along with you, else if her visa was granted after Jul'12 she has to stay as your dependant for five years to be eligible for ILR.

After your second extension not required to apply again for your wife even though you switched to ILR. She can do her extension before her expiry as PBS dependant.
