Post by Star » Fri Oct 29, 2004 3:22 pm

Hi DEars
I ve submitted an afidevit that we were engaged for more then one year ie in Jan 2002 but were married in Nov 2003, and i ve applied at 27th May 2004. means less then 2 years of marriage time. In our culture we cant live with our fiancee before marriage , I ve explained this in my cover letter. Does it work????
Thanx

I think the key issue is not just been married but living together (cohabitation), cos even if u are married but not cohabiting, you will still not score the point while unmarried couples who cohabite for 2 year or more and can provide the evidences required will get the point. I believe that the provision deliberately recognises fiances (but those cohabiting).

I guess the reason why they are not making it convenient for people who are even married is that they probably want to avoid people getting married quickly just to support their application (just my opinion pls). Marriage certificate ordinarily evidence marriages but you will observe that they still ask for 3 or 4 more evidences of cohabitation.

I believe the rule is flexible enough though, after all it says that if you dont have documents addressed to both of you jointly, documents addressed to each person apiece but to the same address will suffice.
Its easy to follow the crowd, it takes courage to stand alone !

Star,
if you were not living together or rather can not show that you were living together for 2 years then your chances of getting the 10points are very slim. I am sure they know about the differences in cultures around the world, which is why they actually give points for umarried partners. this becoz in some countries people stay together for more than 5 years, buy a house together have children etc, without getting married. so they see these as being the same as a marriage.
I know it does sound unfair but i think even if they did not consider co-habitation, the requirement would still have been two years of marriage

8.6.3 If you are applying as a married couple you must supply a marriage certificate/ licence plus three items of correspondence of the kind, or from the sources, listed below, which have been addressed to you and your spouse over the past two years, and which clearly show that you have been living together at the same address. If you have not received any such correspondence that is addressed to you both, jointly, it is acceptable to provide two items addressed to one of you and one item addressed to the other partner so long as they show the same address

The only advantage of being married comes when you are applying for entry Clearance
