HSMP xtension refused(Not covrd by JR)-Expert advise needed

HSMP xtension refused(Not covrd by JR)-Expert advise needed

Dear forum members

I need some advise on this particular scenario:

HSMP extension applied before 7 Nov 2006 on the basis of economic activity. Since application was made before 7 Nov 2006 therefore not covered by JR.

Background and timelines are:

1. HSMP extension applied on Sep 2006
2. After loads an loads of corrospondance HO finally refused the case on May 2007.
3. Appeal lodged with AIT which was herd and refused on Dec 2007.
4. Another appeal is lodged with administrative court which is not decided yet.


Now the question is, can applicant apply for a brand new HSMP extension application now while appeal is awaiting hearing? If he/she can then which application form to fill(Tier1) General or FLR(Tier1) form? and what would be the procedure.

I stand to be corrected but I don't think you can apply for a fresh extension application when an appeal is pending (on a similar "extension" application).

FLR Tier 1 (HSMP) form is the one you should use to apply for extension (if and when you can).

I think HMRC with drawn all pending court appeals...As sush said you can send HMSP1(review) form for your extension...I think you no need to pay any fees as you already paid the fees...

fill the HSMP1(review) form and write a nice covering letter with all the facts and court reference number...

1. I hope you meant UKBA and not HMRC (Revenue and Customs??).
2. If you read my earlier post carefully, you'll note that I have nowhere advised OP to apply for review / extension!! Moreover, sening a review form when an appeal is already pending doesn't make sense - what will OP request a review for??

NutanRaj - Applicant does not fall in the category you have mentioned. Applicant is not covered by JR as extension application was considered under the old rules (i.e economic activity) as it was lodged before Nov 2006 change of rules.

sushdmehta - Thanks a lot for posting your valuable comments for the post.

My only question is: Is it possible to make a new extension application when original extension application refusal is awaiting court hearing in administrative court?
