HSMP review n my chances??

I applied for HSMP during March 2008end but got a refusal in the first week of August on the grounds that incentives which are not reflected in the wage slips cannot be included in the previous earning.

I had enclosed a seperate letter issued by the employer which stated exact date and amounts received towards the incentives earned. This letter was over and above the wage slips and were properly signed and stamped by the employer on the letter head. There were corresponding entries in the Bank statement also.

I have applied for the review. I haven't sent anything extra but the form and justifying my claim in the limited space they provided in my own writing as one can hardly type in that. What are my chances???

Hi Jack,

I believe incentives should be considered part of your earnings and that too you have submitted docs signed by your employer. Is there a clause/or statement in your offer letter which says that incentives will be offered ?, if yes, then you can show that to the CW. I know that Bonus (variable pay component) is accepted in the earnings section, there shouldnt be any reason to reject incentives as part of your earnings.

109. We will only accept allowances as earnings if they are declared in the applicant’s payslips and there is a contractual obligation on the employer’s part to make these payments.

So Ganeshji is right. So in case your contract mentions that you would receive xx amount every month that is not a part of your payslip, you should send the contract too.

Please note that none of the letters issued to me states that the company has a variable pay concept. the co. has a seperate incentive policy and has actually paid that in my account. It has also deducted Tax on the same at source. I have submitted a seperate letter of details of payout of incentives and it is also reflecting in my bank stmt.

Will that be of any help.???
