Please share your thoughts on my case and if there any helps will be most appreciated!
HSMP approved on 21 August 2008
1st EC application made on 5th Sep 2008, rejected.
reason: documents provided did not demonstrate I am in pocession of the funds in the account for the sepcific period (only that sentence no very clear reasons)
Docs submitted:
- all docs were submitted for HSMP
- more than 8 month bank statements (joint account with husband), more than 2800 GBP more than 3 months, official bank papers, stamped, except the last statement which covered 2 days weekend (30 & 31 August 2008)
- letter from the bank comfirmed the level of the funds, however, 1 day older than 7days rule.
Me and my husband are separated, so I ticked on the application box (now have been proven that it was stupid).
2nd application made on 29 Sep 2008---still waiting, but nearly 1 month
- apart of the docs were sent for HSMP, I give new bank statements, and letter from the bank, all stamped and signed by the banking dept manager, within 7 days to the application. (no many transactions but a standing order every month paid out to China, and the last paid out date was 22 Sep 2008)
- letter from my husband, addressed to the BHC, letter confirmed and acknowledged that I have full access and ownership of the funds in the account, and has done so since the account was opened in 2006. (signed by my husband, and he leaves contact details)
So, I understand that since I said I am separated with my husband, so a joint account maybe be frozen or the money is under consideration of sharing, but do anyone here think that my husband's letter will help? BIA's guidance was very unclear, it only says that joint account can be accepted, applicant just need to be named with other holder(s).
I even did not receive the AR notice form with the refusal letter...
Please kindly look at my case and share your thoughts! I have became unemployed as the result of the refusal, and life has been unsettled for the past 7 months. please help!! Many thanks!!!
