I came to the UK under the Highly Skilled Migrant Programme scheme on July 2006. Later my wife joined me as a dependant in the same year. We both got our FLR extended until July 2011. Upon pregnancy in August’08 she went to India and stayed there for her delivery upon medical advice.
As I have to apply entry clearance visa for my baby born in India on 4th February 09 could you please clarify whether I have to demonstrate maintenance requirement as per the new points based Tier 1 system or am I still covered under the old HSMP policy by which I entered UK.
For your reference according to VAF10, under part 5 section on Maintenance it is stated as below.
“The maintenance requirement is not the same for all tiers and sub-tiers of the Points Based System. You should also refer to the specific Policy Guidance relating to the tier/sub tier under which the main applicant is applying or under which he/she has entered the UK or been granted entry clearance, for the details of the amount of funds and evidence you will need to provideâ€
