Maintenance funds requirement

Maintenance funds requirement

I've been in the UK under the student visa (4yrs) then IGS (1 year).
I have gathered enough earnings to apply for the HSMP.

Unfortunately, at the end of my IGS, I was travelling outside the UK
and only manage to re-enter UK one day after EXPIRY of my IGS,
now as a tourist.

Can I still apply for HSMP within the UK with the help of a lawyer?

The alternative is for me to go back to my home country to re-apply.
But now I faced the £2800 maintanence requirement instead of £800.

I managed to keep a balance >£2800 for the last 8 months but
UNFORTUNATELY, it went down to £2500 three weeks ago.

Can I used an online bank statement (with my name and acc. no)
showing only the period from 16 March to 17 June
BUT signed and stamped on the 8 July
and I probably will submit my application on the 15 July.

Is it legal to do this? (i.e. not maintain the required funds from the last balance date to the application date, but maintaining the funds for 3 months up to the last balance date)

My last problem is that the funds is maintained in two accounts,
one of which has little transactions.

Account 1:
statement from 16 March to 17 June
funds always greater £1500

Account 2:
statement from 16 March to 1 July
funds always greater £1500

It is clear the overlapping period of two account I manage to maintain
above the required level.

My concern is they will use 1 July as the starting date and
assume £0 for Account 1 on 1 July and complained
I did not maintain enough fund on that day.

Technically, in my opinion, you cant

illegal- may be not but against the spirit of the rule. If HO decides to check with you Bank then it may result in a rejection. 1 month window has been provided for applicants to arrange statements/letters from Bank etc. If you go by the spirit of the law/rule, you should have such funds available when you enter UK.

Should not be a problem if you explain it clearly in a tabulated form in your cover letter.

Technically, I follow the policy guidance and shouldnt they judge purely based on the policy guidance as well? If we go by the spirit of the law/rule,
shouldn't I be required only to maintain £800 as I spent the previous 5 years in the UK studying and working and I should be able to look after myself.

Should I go ahead with the application?
Upside is I dont have to be unnecessary unemployed for the next four months (3 months waiting for maintenance fund + processing time).
Downside is I will lose about £500 (air ticket) + £800 (visa fee) which add further strain on my financial condition.

I have spoken to a consultant and he thinks my bank statement looks dodgy because the stamped date (9 July) is way after the last transaction date (17 June).

Please advice. I wonder is there any caseworker in this website who can his/her opinion anynomously.
