Grounds of appeal - how to prepare it in the appeal form

Post by quoc » Mon Sep 21, 2009 10:30 pm

Dear all,

I have my leave to remain application (Tier 1) refused because of my electronic bank statements with no signature or stamps from the bank on them. The HO gave me a right of appeal suggesting that the appeal must be made on one or more of the following grounds:

1. that the decision is not in accordance with Immigration Rules

2. that the decision is unlawful because it racially discriminates against you

3. that the decision is unlawful because it is incompatible with your rights under the European Convention on Human Rights

4. that the decision breaches right which you have as an EEA National ...

5. that the decision is otherwise not in accordance with the law

6. that the discretion under the Immigration Rules should have been exercised differently

7. that your removal from the UK as a result of the decision would:
a. breach the UK's obligation under the 1951 Refugee Convention
b. be incompatible with your right under the European Convention on Human Rights.

I don't understand my appeal for those unsigned (stamped) electronic bank statements will fall to which one of those grounds as they suggested above?

What should I write in the ground of appeal section in the appeal form?

Please help me to understand that clearly.

Any suggestions will be appreciated.

Thanks a lot for your help.
