Applying for Tier 1 from USA

Post by Techie_007 » Sun Nov 08, 2009 8:45 pm

Hi,
I am applying for Tier 1 visa from USA.Could anyone please clarify my doubts.
1) I have filled my application with spouse and child details and fixed an appointment for my biometrics. Should I fill dependents form now and should we take biometrics together or should I wait for my approval and then later submit their forms? When should I apply for my dependents?

2) Is there any condition that one should enter UK within 6months of approval?

3)What do they mean by entry clearance? Is it the visa? Will it be a stamped visa like the one we get in US?Will it be done along with the approval

Thanks.

>> Sorry ... I have no idea.

>> There is no condition as such set by the UK Home Office to enter UK within 6 months. You can enter UK anytime before the expiry date of your visa.
However, late arrival could affect your visa status in the future. ie., currently, in order to secure the ILR ( Indefinite Stay/ Leave to Remain), one has to be in UK for 5 years. If you are coming here on Tier1, then, you should complete the initial 3 yrs and an extension of 2 yrs. So, sooner you arrive, better for you ... preferably not later than a month.

3)What do they mean by entry clearance? Is it the visa? Will it be a stamped visa like the one we get in US?Will it be done along with the approval

>> For Tier1, the visa is granted for 3 yrs and it is called as 'Entry Clearance'. Yes, the visa that is stamped on your passport will be titled as 'Entry Clearance'. Once you complete this period, you will be given an extn of 2 more yrs which is called as 'Further Leave to Remain'.
But, I don't have any idea abt what will be the title of this in the visa.

Hope this is clear and answered your queries.

In old world of HSMP, visa was granted in two stages as below.

Stage 1: You apply for visa with all your document(but without passport) to Home Office or BHC. You get approval letter for this.

Stage 2: Once you receive approval letter, you sent your passport for "Visa Stamping" (also called as Entry Clearance) after which you can travel.

But in Tier-1 world, you apply to HO or BHC with your documents+passport and you receive stamped visa along with your other document. In a nutshell, above mentioned two stages are reduced in one.
