Applyg for Tier 1 Visa with current H-1B work visa frm USA

hi, i am currently in the usa on a H-1B work permit (valid till oct 2012) and am planning to move to the UK on a Tier 1 visa to work in my company's UK mfg site.
a. my wife is on a dependant H4 visa (valid till oct 2012) in america, but the visa stamp on her passport is expired. this is pretty normal and she can remain in the usa until oct 2012, but if she leaves usa before that, she needs a fresh visa stamp to get back into usa.
- since i am short on time, if i were to apply under the Tier 1 dependant visa for my wife, is there a problem if the passport has an expired visa stamp, but the permit (most important) is valid until 2012?

b. my daughter was recently born in america and she will have a US passport.
- since i am short on time and may not be able to wait for her passport, can she enter the UK on the strength of her US passport and can I then apply for the Tier 1 dependant visa for my daughter inside the UK?
