India Earnings claimed confusion - Urgent response required

India Earnings claimed confusion - Urgent response required

Hi,

I am desparately in need of expertise advise on my Tier 1 issue, Application is submitted on 13th Jul 2010 through PEO

1. I reached UK on 17th Jan 2010 and currently on WP.
2. On 13th July 2010 have applied for Tier 1 (General) through PEO and my application is currently on hold due to previous earnings claimed points not meeting as per UKBA guidelines
3. I have claimed points for earnings starting 1st May 2009 To 30th Apr 2010 this also includes my UK salary from 17th Jan 2010 to 30th Apr 2010
4. UKBA claims that we can't apply the multiplier 5.3 for india earnings from Jan 17th 2010 as i was not in India physically for those earnings and hence does not meet the earnings of £75000 as required.
5. earnings claimed as below

India componant from 1st May 2009 to 30th Apr 2010

Total Salary 1002253
Exchange Rate 0.01416
Amount in GBP £14191.90

Equivalent UK salary with multiplier : 14191.90 * 5.3 = 75217.08

UK earnings from 17th Jan 2010 to 30th Apr 2010

Amount in GBP £8630.34

Total earnings claimed are

75217.08 + 8630.34 = £83847.42

6. I have faxed a revised justified earnings claimed as below

India earnings are claimed from 1st May 2009 to 31st Jan 2010 ( Jan 2010 india payslip only and not claiming for UK salary)

Total Salary in INR 897319
Exchange Rate 0.01416
converted into GBP 12706.03704
Multiplier To GBP 5.3 67341.99631


I am not applying the multiplier for the months of Feb, Mar & Apr 2010 India earnings as I have relocated to UK. Please find the details below


Total Salary in INR 104934
Exchange Rate 0.01416
converted into GBP 1485.87

UK earnings claimed from 1st Feb 2010 to 30th Apr 2010

Total earnings in GBP 7775.76

Total earnings claimed

67341.99 + 1485.87 + 7775.76 = £76603.62


I need your expertise advise if my above revised earnings claimed sent through FAX is as per guidelines and will this request be considered by UKBA ?

OR

should i withdraw the application today 15th July and apply new? if i claim earnings from 1st Apr 2009 till 31th Mar 2010 i get the required points.
can i claim from 1st Apr 2009 if i apply on 16th July 2010 ?

your immediate response to my post is highly appreciated as i am really running short of time

UKBA is correct in saying that you cannot use uplift factor to your indian salary claims post 17th Jan. you can only use the uplift factor till jan 16th. So if you are not using the uplift post 17th in your revised calculation then i believe you can go for it not sure though whether they will accept the revised calculations...good luck!!

Could you please suggest if i can consider reapplying today after withdrawing my current application and claim the earnings from 1st Apr 2009 to 31st Mar 2010? Can i show earnings from 1st Apr 2009 ? does this fall within 15 months of previous earnings ? or i have to show from 15th Apr 2009 ?

correct, 1 apr 2009 will fall outside the 15 month period..so if you are reapplying today then it has to be post 15th july 2009..good luck!!
