Switching from Tier-4 Student/Dep. to Tier-1 (General)

Please guys, I need urgent clarifications on the following issues:

1. My wife is on Tier-4 (General) student, her degree will be awarded in Oct. 2010. Can she switch to Tier-1 (General) upon completion of her MSc. in October using her previous earnings before the masters started in 2009?

2. I worked full time for 5yrs in my home country before taking 3yrs "Study Leave" in pursuit of an MBA degree in the United States of America. I'm presently in the UK as a Dependent of Tier-4 (General) student, can I switch to Tier-1 (General) using my previous earnings as my study leave is without pay and I'm due for resumption May, 2011.

Your prompt response will be appreciated.

Both you and your wife can switch but by only claiming earnings within the last 12 months before applying. Earnings can not be back dated excepct maternity or adoption reasons.
