Can I get a TIER1 visa without restriction to training ?

Can I get a TIER1 visa without restriction to training ?

Hi .. I Work as a CT2 doctor ( training post) .. for 14 months now .. I applied for TIER1 visa and they gave it to me but with the restriction "not to work as doctor in training" .. so i had to refuse the visa and withdraw the application so not to loose my current job

however ,
I revised the data on the UKBA site http://www.ukba.homeoffice.gov.uk/worki ... switching/ under "conditions of ur stay " it says clearly :

Additionally, you may not be not employed as a doctor or dentist in training unless:
you have obtained a degree in medicine or dentistry from a UK recognised or listed body, or from a licensed sponsor under Tier 4 of the points-based system; or
your current permission to stay is not subject to a condition restricting your employment (whether or not that is employment as a doctor or dentist in training), and you have been employed here as a doctor or dentist in training during your current permission to stay.

Also , I know one of my colleagues who did the same as me and they didn't get the restriction

So, Can I get the tier1 visa without this restriction ??

If you are currently on Tier 2, then , as per the rules, no - because your Tier 2 permission to stay restricts your employment to the stated sponsor only.
your current permission to stay is not subject to a condition restricting your employment (whether or not that is employment as a doctor or dentist in training), and you have been employed here as a doctor or dentist in training during your current permission to stay.
