Tier1 visa extension - Query

I have a query in the visa extension rules as to under which category [1. Tier1 (General) 2. HSMP extension 3. FLR Tier1 (HSMP)] I should apply for my visa extension.

I am currently holding Tier1 Visa valid from 30-Jul-2008 to 30-Jul-2011. I have made my initial application in Dec 2007 and I was provided with a HSMP approval letter dated 21-Jan 2008 valid till Jul 2008. I have made my entry clearance application in July 2008 using the approval letter and got the Tier 1 visa.

There is a confusion that I may be treated under HSMP (section 3C) as I was made my initial application through HSMP approval letter. I have also learned from my friends that I may be treated under HSMP judicial reviews policy ruIes (FLR Tier1(HSMP)).

As my Initial application was made after 7th Nov 2006, I don’t think that I will be treated under ‘HSMP judicial reviews policy’ rule. Can you guys please confirm?

Also can you please confirm under which category I have to apply my extension

(i) Tier1 visa (General) – using Section 3B of the extension form.

(ii) HSMP Holder – using Section 3C of the extension form.
