Confusion about ILR application

Hi Guys,

I got HSMP VISA granted on 26 March, 2008. The VISA was valid from 18 Apr, 08 to 17 Apr, 2010 and was assessed under HSMP Entry clearence rules before Feb29, 2008. I migrated to UK on 20 Aug, 2008 for interviews, stayed for 3 weeks and then came again on 1 Nov, 2008 to join new job..

As my visa was goin to expire in Apr,2010 and i was getting married, i applied for extension to stay in Dec, 2009. I was given awarded extension under Tier1 PBS category and points awarded were based on HSMP rules (bachelor Degree was awarded pts). The extension is valid from 18 Apr, 2010 to 17 Apr, 2013.

Now i am confused abt what will happen after 17 Apr, 2013? I am aware that one can apply for ILR if he stays continuously and legally in UK for 5 years with no absence longer than 3 months. But in my case, i migrated to UK on 20 Aug, 08 and i will not complete 5 years of stay on 17 Apr, 2013? What will i need to do then?

If i need to apply for Tier1 extn again, how will they assess my application? Remember i havent got Masters degree.. Will i get extn or not?

Can you guys help me clarify this doubt?

In line with the immigration rules and policy guidance in force at that time. Can anyone tell you today what the policy documents will state in 2013? IMHO, no.

Thanks for ur response.. I understand that i will need extn but am unsure how will they assess my application? You are right, no one can guess what rules will be in place then.

Do you know what are the current rules? If someone like me with no master degree apply Tier1 extn , will they get points for bachelor degree?

In PBS self assessment, they ask for first successful Tier1 application? Which date will be applicable here. My HSMP VISA date (i.e. 26 March, 2008) or Tier1 extn (Dev,2209)??
