Does the WP or HSMP has to be continuous to get ILR

Post by saurya_s » Thu Apr 06, 2006 5:31 pm

Hi all,
Does the WP or HSMP has to be continuous to get ILR?
For example if I have
4ys of student visa + 4yrs of Work permit and 1 year student visa + HSMP 2 years. Do I qualify for ILR?
I guess I would be 10 years lawfuly for ILR? What happens to my spouse and kid. My partner makes 8years when I make 10 and my kid was born here and he will be 5?

It needs to be continous for it to be taken into consideration.

Your spouse and kid will get the ILR when you qualify for it as they will be your dependent. You should qualify under the 10 year rule although perhaps someone else can confirm this as I know very little about the 10 year rule.

I am assuming from your post that you were on a work permit for 4 years 3 years back. Why didnt you apply for ILR then as you would have qualified.

Hi Moderator,
No the case I have suggested is hypothetical one. I have 4 years of student visa and I am currently on work permit - I will complete four years in Aug, so older 4 year rule is not applicable to me. Considering this, I planned for one year MBA from Sep 2006 and my admission and fee deposit was done in Dec 2005. Now with the introduction of new rule, my plan to pdo MBA after ILR has failed. It seems I will hjave to go back to student visa. Secondly can I get an HSMP and reduce my working hours to pursue the course? I will be economically active but with less income?
Thanks
