Have received a very good offer outside UK what to do

Post by srirama9999 » Mon May 22, 2006 5:14 pm

Friends Moderators

I am in UK on HSMP which is valid upto 2010, I have received a very good Job offer from a company in Germany to work in Germany/ India which I am thinking of taking up. I need following advise urgently.

1. If I spend 1 year or more working outside UK, how will it affect my HSMP, will I get ILR when I apply in 2010 ?
2. If I work outside UK can I still visit UK on my HSMP valid visa till 2010 or I can be refused entry as I will not be working in UK ?
3. What is the best solution in the above circumstances.

Pls Advise

If you stop living in the UK your visa becomes invalid. If, when you enter the country, the immigration officer believes you live abroard he will probably refuse you entry and stamp your visa accordingly.

Basically, you need to decide where you want to live and work.

Of course you don't change the rule in the middle of the game!

The rule says you must make UK your permanent home which you agreed to in black and white? what is the probability that by next year you will not get an offer at Iraq or US. like the last writer said, decide where you want to decide, the grass is always grener at the other side of the fence.......

cheers

Everytime you enter you enter UK they will ask you in the immigration check point. How long did you spend outside UK ?. (I am speaking from experience)
You might answer less then 3 month which is acceptable but if they have any mean to find that you are lying, you will probable be bannedd to enter UK for the whole of your life.

You need to consider the benefit of working outside UK and what you get in your new new job, of course only you could answer this questions as only you know very well all your circumstances, and there is not much information about this things. I will suggest make a list about the advantage and disadvantage of wokring in the UK and outside UK, it will make youmore clear to make adecision.

Dear Pantaiema

Thanks for the detailed reply.

The offer I have far outweighs what I am doing in UK, so I may go ahead and accept this offer.

My question however is if I decide to forgo my HSMP status and decide to settle elsewhere, does it mean I will not be able to enter UK ever after even as a visitor or for short visits on Business Purpose ?

Can Moderators/ Senior members please share their opinions to help me take a very important decision of my career.

thanks

I totally agree with Dude

What is HSMP for, to find a job without hurdle of appying for work permit. And you get better deal outside alreday inlcude two things (work permit and job) so there is no point to worry about your HSMP status.

I have a friend who had an ILR and was working for one of the top UK Universities but spent all his time back home. He was being paid in the UK, was paying taxes and visited the UK 3-4 times a year. He was waylaid at the immigration desk on one of his visits and quizzed about his time spent out of the UK. His indefinate leave was cancelled but instead was allowed to enter as a visitor.

They do not like people to hold residency or indefinate leave if they spend too much time out of the country. However, they do not have any problems in them visiting on business/tourist visas thereafter.
Hope this helps.
