Maintenance funds for Dependent of Tier -1 General Visa

Post by ramana2uk » Sat Aug 06, 2011 4:41 pm

I am in UK from less than 1 year on Tier 1 General Migrant Visa.
I have applied dependent visa for my wife and child (2.11 years old) on 25th July 2011. Entry clearance officer rejected my visa, stating insufficient funds in my account.
I have maintained the funds in bank in UK of GBP 1600 (for my self) + 1600 ( for my wife) + 1600 (for my child) = 4800 GBP.
As per my understanding, as per the pbs policy guidelines these funds are more than sufficient.
Now I wanted to appeal against the decision taken. Please confirm me whether I am correct or not and also suggest me how I need to proceed.

Thanks in Advance.

You don't need to show maintenance for the PBS migrant if you are not all applying at the same time (even though you've actually shown maintenance for the PBS migrant, which makes your refusal even more bizarre!)

(e) Where the Relevant Points Based System Migrant is applying for entry clearance or leave to remain at the same time as the applicant, the amount of funds available to the applicant must be in addition to the level of funds required separately of the Relevant Points Based System Migrant

See similar discussion. Your appeal should cite Appendix E of the immigration rules.

It could take six months if the ECM review (the first stage of the appeal) does not agree that is was a mistake to refuse. If the ECM review agrees that it was a mistake it could be done in 8 weeks.
