Tier 1 ILR issue

Post by expertbuddy » Tue Mar 03, 2015 1:39 pm

Hi Guys,

Thanks for all the information on the board

I got some clarifications which i thought of clarifying with the experts whether to extend My Tier 1 visa

Tier 1 Visa validity starts - 18 Feb 2011
First arrival in UK on - 12 March 2011
1st extension of Tier 1 - 18 Feb 2016

So from the documents and rules i am eligible to apply for ILR before 28 days i.e., 24 Jan 2016

24 Jan 2016 - 25 Jan 2015 - 0 days leave
24 Jan 2015 - 25 Jan 2014 - 0 days leave
24 Jan 2014- 25 Jan 2013 - 0 days leave
24 Jan 2013 - 25 Jan 2012 - 50 days leave ( Paternity leave continuity split +Annual leave)

(25 Jan 2012 to 05 Feb 2012 - 12 days)
(05 Nov 2012 to 12 Dec 2012 - 38 days)

24 Jan 2012 to 25 Jan 2011 - 83 days leave ( Paternity leave start split +Annual leave)
(25 Jan 2011- 12 March 2011 - 47 days)
(23 Apr 2011- 28 April 2011 - 5 days)
(31 Aug 2011- 18 Sep 2011 - 19 days)
(14 Jan 2012- 25 Jan 2012 - 12 days)

Is the above leaves OK ? and need clarification on some rules below (bolded line). I was worried because for sometime i was working from india for few days during my holidays and it exceeds the annual leave entitlements.
https://www.gov.uk/government/uploads/s ... eriods.pdf
Absences must be connected to the applicant’s sponsored or permitted employment, or the
permitted economic activity being carried out in the UK, for example, business trips or short
secondments. This also includes, any paid annual leave which must be assessed on a case
by case basis and must be in line with the UK statutory annual leave entitlement.
or I should go to another extension? Also just out of cuirosity is the ILR rules going to be same till next year or they are going to change after April 2015

Thanks

Get a letter from employer for you UK absences. You should be fine and no need another extension.

Suresh
